Terms of Use
These terms govern use of the public Camblish website, Camblish LMS, the Xcelerate Android application and related online services.
1. Provider and acceptance
The services are provided by Camblish Training Institute, 51 Harrison Street, Johannesburg, 2001. Contact [email protected], 011 024 9246 or 061 035 8120.
You accept these terms when you access or use the services. If you use a service on behalf of an employer or organisation, you confirm that you are authorised to do so. If a lawful parent, guardian or representative must authorise use, that authorisation must be obtained.
2. Accounts and credentials
- Provide accurate, current information and correct errors promptly.
- Keep passwords, access tokens, devices and one-time codes confidential.
- Do not share an individual account or impersonate another person.
- Notify Camblish promptly about suspected unauthorised access, a lost device or an incorrect role or project assignment.
- Access only information and functions authorised for your role, project, employer, provider, department or learner group.
Camblish determines identity and permissions from the authenticated account and server-side records. Displaying a person or record does not automatically grant permission to act on it.
3. Services and programme rules
Camblish services may include public information and forms, applications, LMS courses, assignments, assessments, attendance, workplace monitoring, evidence submission, messaging, support, reporting and optional app-to-app voice calling.
Specific programmes may impose additional rules for attendance, assessment, evidence, conduct, deadlines, workplace access, employer oversight, SETA or QCTO compliance. Those lawful and communicated rules form part of the service conditions for the relevant user.
4. Acceptable use
You must not:
- Use the services unlawfully, fraudulently, abusively or to harass another person.
- Submit false attendance, identity, assessment, evidence, employer or programme information.
- Attempt to bypass geofence, verification, role, scope, assessment or security controls.
- Access another account, intercept communications, probe systems or introduce malicious code.
- Upload unlawful, harmful, infringing, deceptive or unnecessary confidential content.
- Copy, scrape, reverse engineer or redistribute protected services or learning material except where law or written permission allows.
- Use messages or calling for spam, advertising, threats or unrelated mass communication.
5. Attendance, location and verification
Where enabled for a programme, Xcelerate may record clock-in and clock-out, attendance status, session or workplace details and verification evidence. A policy may require GPS, geofence status, trainer PIN, QR challenge, verification question, approved biometric method or documentary evidence.
Users must not falsify attendance or allow another person to check in on their behalf. Location and biometric functions are described in the Location, Attendance and Biometric Notice. Missing permissions, weak GPS accuracy, unavailable infrastructure or failed verification may prevent a check-in where the programme requires that method.
6. Learning content, assignments and assessment
Course material, assessments, platform interfaces, branding and related intellectual property belong to Camblish or the relevant licensor. Enrolment grants a limited, personal, revocable right to use material for the authorised training purpose.
Learners remain responsible for their own submissions unless collaborative work is expressly allowed. Uploading another persons work as your own, manipulating completion or interfering with grading may lead to investigation, correction, suspension or programme action.
7. Messages, support and uploads
Users may send authorised messages, support requests, comments and files. You remain responsible for content you submit and confirm that you have the right to submit it. Camblish may retain, review, restrict or disclose content where necessary to provide support, enforce rules, investigate safety or security concerns, comply with a lawful request or maintain programme evidence.
Do not use normal chat or email to send passwords, private keys, unnecessary identity documents, biometric templates or highly sensitive information when a secure upload path is available.
8. In-app voice calling
Calling is available only when enabled by Camblish and supported by the users role, scope, device and availability. The caller identity comes from the authenticated account. Calls may be blocked, rejected, cancelled or ended, and abusive callers may be restricted.
WebRTC carries live audio. Camblish does not intentionally record call audio. Call metadata may be retained for history, support, safety and audit purposes. Normal mobile data charges and device microphone permissions may apply.
9. Privacy and personal information
Use of personal information is governed by the Privacy Policy, Data Deletion and Privacy Requests, the attendance notice and any applicable programme-specific notice. Users must respect the privacy and confidentiality of information visible to them.
10. Availability, changes and third-party services
Camblish aims to provide reliable services but does not promise uninterrupted or error-free access. Maintenance, connectivity, device limitations, third-party infrastructure, security incidents or events beyond reasonable control may affect availability.
Some functions depend on Moodle components, hosting, email, SMS, push notifications, app stores, maps, Firebase, signalling or TURN services. Third-party terms may apply to those services. Camblish may change, improve, suspend or discontinue a feature while protecting existing records and legal obligations as reasonably possible.
11. Disclaimers and limitation
Public calculators, estimates, articles and guidance are for general planning and must be verified with an appropriately qualified adviser, SETA, SARS, QCTO, accountant, consultant or legal practitioner where relevant. They are not a guarantee of funding, accreditation, tax treatment, employment, admission, assessment outcome or certification.
To the extent permitted by South African law, Camblish is not liable for indirect, incidental or consequential loss arising from unauthorised use, user-supplied information, external networks, unsupported devices or third-party services. Nothing in these terms excludes liability or rights that cannot lawfully be excluded.
12. Suspension, correction and termination
Camblish may restrict or suspend an account or function where reasonably necessary for security, suspected fraud, abuse, programme completion, expired authorisation, legal compliance or breach of these terms. Records may be corrected where an error is confirmed. Suspension does not remove records that Camblish or an authorised programme party must retain.
13. Changes, governing law and contact
These terms are governed by the laws of the Republic of South Africa. Camblish may update them when services, risks or legal requirements change. The effective date and version identify the current published terms.
